On 22 December 2009 US Citizenship and Immigration Services (USCIS) announced that all 65,000 H-1B cap subject visas have all been fully used up for the fiscal year of 2010. Any H-1B visa applications properly filed by 21 December 2009 will be subject to a computer generated random selection process. Unfortunately, this means that some properly completed H-1B visa petitions will be returned.

A United States congressman has proposed a new 'start-up' visa which would make it easier for foreign entrepreneurs to start companies in America.

US Citizenship and Immigration Services (USCIS) confirmed recently that a number of immigration programs will be extended at least until 30 September 2012. This is following the signing of the Homeland Security (DHS) Appropriations Act of 2010 by the President on 28 October 2009. This covers the following programs:

USCIS announced on 13 November 2009 that approximately 55,600 H-1B cap subject petitions had been filed. Also, that as already announced all 20,000 H-1B visas available for aliens with advanced degrees had been used and that new H-1B petitions filed for those with advanced degree will be counted against the general H-1B cap of 65,000.

The number of H-2B visas available per fiscal year is 66,000. These are allocated on the following basis:
